How Much Do Lawyers Charge in Ghana? Fees for Different Cases and Tips to Pay Less

The Ghana Bar Association has established fees that clients are expected to pay its members based on the type of case and the years of experience a lawyer has among other factors.

Legal practitioners are required to adhere to these approved charges strictly. Overestimating fees is considered misconduct, and lawyers can risk losing their licenses. Conversely, undercharging is deemed detrimental to the legal profession.

Remuneration for legal services must measure up to the value of the time spent or value created as determined by the economic environment in which the service is provided.

The Scale of Fees covers charges for professional services rendered by lawyers. Fees are quoted in both Ghana Cedis and US Dollars and are to be applied to services rendered to Ghanaian clients and international clients respectively as prescribed by law.

The essence of these guidelines shall be negotiation and agreement between Counsel and the client within the range prescribed below before the commencement of the provision of legal services. The law entitles every lawyer to reasonable compensation for his services. In negotiating for fees a lawyer shall adhere to these approved tariffs and shall avoid charges which either overestimate or undervalue the service rendered, though in legal aid cases, the poverty of the client may require a less charge or even none at all.

The negotiation will take into consideration the nature and/amount of work involved and estimated time to be spent on it. The terms of payment may include a deposit of up to fifty percent of the agreed fees payable upon firm instructions being given to commence work unless the Client and Counsel agree otherwise. In negotiating the terms of the fee, Counsel and the Client may agree on any method/basis and terms of payment acceptable to them including:

  • Fixed fee;
  • Fixed fee plus success fee;
  • Hourly fees;
  • Hourly fees plus success fee; and
  • Fixed fee for part of the work and hourly fees for the other part.

Where percentage rates are applied in computing fees, they may range from five percent (5%) to twenty-five percent (25%) unless otherwise agreed.

Hourly Rates

Ghanaian Clients

Hourly rates may range between the amounts stated below unless otherwise agreed:

  • Counsel (5-9 years) GH¢1, 000 – GH¢3,000
  • Junior Counsel (under 5 years) – GH¢600- GH¢2,000

International Clients

Retainer Fees

The law permits a lawyer to accept retainer for advice. However a lawyer shall be separately instructed and separately remunerated by fees for each piece of work done, and shall not undertake to represent any person, authority or corporation in all their court work for a fixed annual salary. The minimum rate for retainer may be GH¢8,000.00 per month depending on the scope of work contained in the retainer provided that the clients shall be entitled to free consultation in addition to a discount of up to twenty percent (20%) for other legal services.

 Out-of-Pocket Expenses

These are incidentals, costs and out of pocket expenses incurred in the provision of legal services on behalf of the Client and should be discussed at the start of the engagement. They may include filing fees, stamping of documents, swearing of affidavits, service of processes, telephone, fax, e-mail, photocopying, printing and binding, courier services, transportation and accommodation, preparation of appeal records, execution of judgments and notarization among others. These shall be billed for separately and paid by the client. A deposit should be paid on account by the client before commencement of work. Out-of-pocket expenses should be billed be at cost because expenses are not profit items.

Brief Fees in the Circuit & High Courts

The following brief fees shall be charged for cases falling under these headings:

  • Land Litigation – 10% – 20% of the value of the land or hourly rates would apply if the work involved exceeds the 20% value of the land.
  • Labour Litigation – 10% – 20% of the total award or hourly rates would apply if the hourly rates exceed 20% of the claim.
  • Human Rights Litigation – GH¢12,000- GH¢60,000 or hourly rates would apply if the hourly rates involved exceed GH¢60,000.
  • Estate Litigation – 5%-20% of the total value of the estate or hourly rates would apply if the hourly rates involved exceed the 20% value of the estate.
  • Maritime Litigation – Ghana Cedi equivalent of US$30,000-US$70,000 or hourly rates would apply if the hourly rates involved exceed US$70,000.
  • Aviation Litigation – Ghana Cedi equivalent of US$30,000-US$70,000 or hourly rates would apply if the hourly rates involved exceed US$70,000.
  • Libel Litigation – GH¢30,000 to GH¢60,000 or hourly rates would apply if the hourly rates involved exceed GH¢60,000.
  • Landlord and Tenant Litigation – 5% to 15% of value of claim or hourly rates would apply where there is no value or if hourly rates involved exceed 15% of the claim
  • Matrimonial Causes
    • Dissolution & Custody only GH¢30,000 – GH¢90,000 or hourly rates would apply if the hourly rates involved exceed GH¢90,000.
    • Property Settlement & Financial Provision contest – 10% – 20% of claim or hourly rates would apply if the hourly rates exceed 20% of the claim.
  • Adoption Ghana Cedi equivalent of US$2000 –US$4,000.
  • Debt Recovery Litigation 10%-25% of value of amount.
  • Company Litigation
    • Directorship litigationGH¢60,000 – GH¢120,000 or hourly rates would apply if the hourly rates involved exceed GH¢120,000.
    • Shareholder Rights 10%-20% of value of shareholding or hourly rates would apply if the hourly rates involved exceed 20% of the shareholding.

    • Representation of clients at the National House of Chiefs will attract the same rates as Civil Appeals in the Court of Appeal.
  • Criminal Trials
    • Bail Application – GH¢5,000 – GH¢30,000
    • Misdemeanor Trials – GH¢30,000 – GH¢60,000
    • Felony Trials – GH¢60,000 – GH¢120,000
    • Indictable Trials – GH¢40,000 – GH¢300,000

Provided that in all cases under Sections and above, hourly rates will be applied where the hours involved exceed the maximum fee.

Brief fees for District Courts

Brief fees for District Courts should not exceed 50% of the brief fees charged in the High Court and Circuit Court.

Refresher Fees

Where litigation stretches over an unreasonably long period, there should be renegotiation on refresher fees after every year provided that the delay should not be traced to the default or inaction of the lawyer. However, where hourly rates apply, there shall be no need for refreshing or renegotiating fees save the review of the hourly rates.

The fees for any conveyance are based on value of the property being conveyed.

Where the value of the property is:

  • Over GH¢400,000.00 and up to – 12% for first GH¢400,000.00 and balance at 10% maximum
  • Over GH¢400,000.00 and up to GH¢500,000.00 – 10% for first GH¢400,000 and balance at 7.5% maximum
  • Over GH¢1000,000.00 – 7.5% for first GH¢1000,000 and balance at 5% maximum

Tenancy Agreement

Fee for tenancy agreements shall be based on the yearly rent and other considerations involved.

Where the yearly rent or other consideration involved is:

  • Up to GH¢40,000 per annum – 15% maximum
  • Over GH¢40,000 and up to GH¢100,000 – GH¢6,000 plus 10% maximum per annum
  • Over GH¢100,000 and up to GH¢200,000- GH¢6,000 plus 7.5% maximum per annum
  • Over GH¢200,000 per annum – GH¢6,000 plus 5% maximum

Alternatively, where practicable, Counsel may charge one month’s rent as legal fees.

Incorporation of Partnership

The Cedi equivalent of a fee of US$1,000 shall be charged for the incorporation of a partnership and the drafting of a partnership agreement shall attract an additional fee range between US$1,000 – US$2,000 payable in the Ghana Cedi equivalent. Hourly rates would apply if the man hours exceed US$2,000.

Company / Registration

A fee range between US$1,000 – US$4,000 payable in the Ghana Cedi equivalent shall be charged for the incorporation of a company. A separate fee ranging between US$1,000 – US$2,000 shall be charged for the preparation of the Regulations of the Company. Hourly rates would apply if the man hours involved exceed US$2,000.

Commercial Agreements

For the preparation of Commercial agreements including research, legal opinion drafting and engrossment or finalization, but excluding conferences with clients:

  • the fee shall be the same as hourly rates for each hour spent, or
  • the fees shall be based on a percentage of the consideration or lump sum involved in the agreement as follows:
    •  Less than GH¢20,000, the fees shall not exceed 15% thereof;
    • Over GH¢20,000, the fee shall not exceed 10% thereof;
    • Over GH¢100,000 but less than GH¢300,000 the fee shall not exceed 7% thereof;
    • Over GH¢300,000 but less than GH¢1000,000 the fee shall not exceed 5% thereof;
    • Over GH¢10,00,000 the fee shall not exceed 3% thereof.

Wills

  • Simple wills (without any trust or limitation or dispositions) – GH¢6,000 maximum, or hourly rates will apply if the hours exceed GH¢6,000
  • Complicated wills – GH¢18,000 maximum, or hourly rates will apply if the hours exceed GH¢18,000

Probate and Letters of Administration (Non – Contentious)

  1. b) Over GH¢200,000.00                                                        GH¢14,000 for the first GH¢200,000 plus up to 5% for any additional value.

The preparation of Vesting Assent and the Winding Up of an Estate should not be included as part of the matters relating to Probate and Letters of Administration and must be treated as separate matters. The fees to be charged for Vesting Assent and Winding Up of an Estate shall be the same provided that where the same lawyer was responsible for the Probate and Letters of Administration, the maximum fee for the Vesting Assent and Winding Up of an Estate shall not exceed 50% of the fees approved.

 

Compensation Claims

Where the lawyer negotiates compensation claims for property, land, et cetera, acquired by government, the fees shall not exceed 15% of the total compensation paid.

 

Debt Recovery

Debt collection, as its name implies, involves the recovery of monies such as rent, contract payments and other debts for and on behalf of clients. This may be achieved in two main ways:

  • by correspondence, or
  • by instituting legal action for the recovery of the debt or by acting on behalf of the debtor for any such action.

All expenses for the recovery of debts should be borne by the client.

 

Debt Collection by Correspondence

Where the amount involved is up to and includes:

  • GH¢50,000 – 10% maximum
  • GH¢200,000 – 10% for the first GH¢50,000 and balance at 7% maximum
  • GHS800,000 – 10% for first GH¢50,000, 7% for balance up to GH¢200,000 and remaining balance at 5% maximum
  • Over GHS800,000 – 10% for first GH¢50,000, 7% for balance up to GH¢200,000, 5% for balance up to GH¢800,000 and remaining balance at 3% maximum

Fees are provided for under brief fees [see Clause E(k) supra]

How to pay Less when you contract a Lawyer

For instance, contracting a lawyer from northern Region, when you are in Greater Accra means, you will have to pay for the transportation fee all the way from the Northern region to Accra.

To avoid this, you need to contract lawyers very close to you or where the case will be in order to pay less.

There are poor people and rich people, the lawyers recognizes that hence if your profile they get to know you have more money than they think, you will definitely be charged more, almost at the end of the chart fees or fixed fees or the hourly rate.

If for instance a Lawyers Charge for the legal service  is usually GHc 40,000, when you show you are rich, you will end up paying all the Ghc 40,000 or more  while someone who is poor can even pay Ghc 10,000 for the same legal service.

Contract a new or Junior lawyer who is intelligent, their Rates are lower than the senior Lawyers and you will still get the same results.

  1. Choose Local Lawyers: Contracting a lawyer close to where the case will be can save on transportation and other logistical costs.
  2. Show Financial Constraints: If you appear wealthy, you might be charged at the higher end of the fee scale. Demonstrating financial constraints can sometimes lead to lower fees.
  3. Hire Junior Lawyers: Junior or newly established lawyers often charge less while still providing competent services.”

These personnel will serve as kitchen assistants, security guards, and teaching assistants to fill gaps within the GES.

Giving a short address on behalf of the Chief Executive Officer (CEO) of YEA, the Deputy CEO in Charge of Operations, Alhaji Bashiru Ibrahim, highlighted the significance of this agreement. He noted that this is the third MoU between the YEA and GES, following successful agreements in 2015 and 2018.

According to Alhaji Bashiru Ibrahim, the latest agreement will enable the YEA to recruit:

  • 4,000 kitchen assistants
  • 4,000 security guards
  • 2,000 teaching assistants

This effort aims to enhance staffing in schools across the country.

Almost every job comes with some level of stress. Unreasonable client demands, long hours, and the emotional trauma associated with various professions can make employment nerve-wracking. While many people find ways to manage and overcome stress, some struggle significantly with the pressures of their job.

According to Mental Health Daily, certain occupations consistently show high rates of suicide. Year after year, dentists and doctors remain among the professions with the highest suicide rates. In the United States, jobs that require significant levels of aptitude, sacrifice, and education tend to have above-average suicide risks. However, contrasting evidence from Britain suggests that occupations requiring lower skill levels are associated with increased rates of suicide.

Here are some of the jobs with the highest suicide rates:

  1. Medical Doctors: The immense pressure, long hours, and emotional toll of dealing with life-and-death situations contribute to high stress levels and suicide rates among doctors. While teaching is not listed among the top 10 professions with the highest suicide rates, it is important to recognize that teachers also face considerable stress and mental health challenges. Public sector workers in Ghana face significant salary disparities despite the implementation of the Single Spine Salary Policy (SSPP). The majority, about 80.93%, take home less than GHS 3,000 monthly. This disparity raises questions about the effectiveness of the SSPP and whether it should be scrapped.

Salary Brackets and Allowances

The current system has created a scenario where the lower your salary, the smaller your allowance, and conversely, the higher your salary, the larger your allowance. This system exacerbates income inequality within the public sector.

Impact of the Single Spine Pay Policy

The Secretary-General of the Trades Union Congress (TUC), Dr. Anthony Yaw Baah, has highlighted how the SSPP has worsened pay differentials in the public service. He noted that the policy has distorted the salary structure, leaving some workers with inadequate salaries. For instance, junior officers outside the Single Spine Salary Structure (SSSS) earn more than senior officers on the SSSS.

Disparities in Pay Increments

In 2022, the highest salary on the SSSS was GH¢7,404 per month, while the lowest was GH¢415 per month. Despite modest pay increments for public sector workers on the SSSS, state-owned enterprises (SOEs) awarded themselves significantly higher increases. Some SOE heads earn over three times the salary of the President, despite managing loss-making entities.

Implications for Workers and Pensioners

Dr. Baah emphasized the serious implications of low salaries and pay inequalities for workers and retirees. Many pensioners receive meager pensions, with the lowest monthly pension being GH¢300, compared to the highest of GH¢142,564. This stark contrast highlights the need for a review of the SSPP to address these inequalities.

The Plight of Retirees

The situation for retirees is dire. Nearly 60% of pensioners on the Social Security and National Insurance Trust (SSNIT) payroll receive less than GH¢1,000 per month. Dr. Baah appealed to President Nana Addo Dankwa Akufo-Addo to support retirees short-changed by the implementation of the National Pensions Act, Act 766.

The Need for Reform

With only 15% of Ghanaians aged 60 or older receiving a pension from SSNIT, a significant portion of the elderly population relies on their families or resorts to begging. This situation underscores the urgent need for reforms to ensure fair and adequate compensation for public sector workers and retirees.

Conclusion

The Single Spine Salary Policy has not achieved its intended goals and has instead exacerbated salary disparities in the public sector. It is time to reconsider and reform the policy to ensure fair and equitable compensation for all public sector workers.

Non-professional teachers must upgrade by December

About 30,000 non-professional teachers in pre-tertiary institutions have been given a window of opportunity to regularise their stay in the classroom by the end of the year.

Under a special dispensation through a collaboration between the National Teaching Council (NTC) and the Ghana Education Service (GES), the teachers have up to December to obtain the appropriate teaching registration and licensing.

They are made up of bachelor’s degree and non-bachelor’s degree holders, who were recruited before the introduction of the licensure regime in 2018.

Under the arrangement, degree holders are required to enrol in a Postgraduate Diploma in Education (PGDE) programme in an accredited teacher education university to be issued a teachers’ registration and licence upon successful completion of the programme.

“This fast-track programme will last for 16 weeks and shall be exclusive for those who were teachers before September 30, 2018.

“All other categories of untrained teachers are required to attend a one-week Booth Camp training in designated institutions and be issued permanent registration upon successful completion of the training.

This shall be exclusive for those who were teachers before September 30, 2018,” the Registrar of the NTC, Dr Christian Addai-Poku, told the Daily Graphic in an exclusive interview in Accra.

Engagement with universities

He said the NTC had started engaging with four universities, namely; the University of Cape Coast (UCC), University of Education, Winneba (UEW), University for Development Studies (UDS) and the Akenten Appiah-Menka University of Skills Training and Entrepreneurial Development (AAMUSTED).

Dr Addai-Poku said he was confident that by August 2024, the engagement would have been firmed up and the teachers concerned would have enrolled.

In July 2022, the council gave a special dispensation to in-service non-professional teachers employed before September 2018 to undergo an exemption exercise to secure the full licence given to such teachers within two years after upgrading to a professional status.

The exemption period will end by December 2024.

Assurance

Dr Addai-Poku gave an assurance that participants in those two programmes would not be required to write the licensure examination, “as this forms part of the transitional arrangements for those who were employed by the GES before the introduction of the licensure examination in 2018.”

Throwing more light on the arrangement, Dr Addai-Poku said the Council, as part of its mandate, conducted compliance checks in senior high schools in six regions in the country, focusing much on teachers’ compliance with the law on teacher licensing.

“The data revealed that 7,100 teachers in the senior high schools in the six regions do not possess the right credentials to be in the classroom,” he said. He said per the transitional arrangement, such teachers needed to be supported to obtain credentials that would qualify them for permanent registration and licensing.

Dr Addai-Poku explained that based on section 67(1) of the Education Regulatory Bodies Act (2020), Act 1023, which states that, “A person shall not practise as a teacher unless the person is registered as a teacher in accordance with this Act,” it was pertinent that immediate steps were taken to ensure that the teachers complied.

“In view of the above, the Council intends to deploy a special dispensation to register and licence all non-professional in-service teachers in the country,” he said. Dr Addai-Poku encouraged all teachers under that category to take advantage of the dispensation to regularise their stay in the classroom by the end of the year.

He reminded the affected teachers to take advantage of it, “because those who will not take up the opportunity before the end of December 2024, even if they upgrade themselves, they will be required to write the licensure examination.”

Teachers and qualified non-teaching staff of the Ghana Education Service (GES) who have not yet received their laptops under the government’s One Teacher – One Laptop initiative are encouraged to generate their collection code by dialing *790*555#.

A statement from KA Technologies in Accra on Wednesday also advised all eligible teachers and non-teaching staff to contact ICT Coordinators in their respective regions or districts for assistance in obtaining their laptops.

The statement highlighted that although almost 96% of all beneficiary teaching and non-teaching staff of GES have already received their laptops, the company is intensifying efforts to ensure all outstanding beneficiaries nationwide take advantage of the initiative as the distribution phase comes to a close.

KA Technologies emphasized that the creation of the collection short code is for audit purposes and to ensure that only eligible teaching and non-teaching staff are served.

Teachers in the Ashanti, Greater Accra, North East, Upper West, Upper East, Northern, and Savannah Regions are to activate their short code *790*555# and contact their ICT Coordinators from Thursday, 25th July, to collect their laptops.

Meanwhile, teachers and non-teaching staff in the remaining 10 regions are to follow the same process starting from Wednesday, 30th July 2024.

Upon dialing the TM1 collection short code, you will receive the following prompt:

Follow the prompts to complete the process. You will need to contact your ICT Coordinator for assistance to receive your laptop. Please bring an ID for verification.
